日本ではおそらく2018年中に相続法改正が実現するだろう。親族法に関しては2012年に親権法改正がなされたが、現在は、養子法の改正の準備が進められている。授業では、一連の改正を大きな流れ（社会の情勢・政府の政策・新判例の登場）の中に位置づけた上で、「子の福祉」「配偶者の保護」「相続の多様」という三つの観点から、近時の立法（案）における主要な改正点について説明・検討する。最後に、長年の懸案である婚姻法・親子法の改正、さらには今後の家族法のあり方について展望する。授業を通じて、この四半世紀の日本の家族法の動向を示したい。また、参加者との間で質疑応答を行い、台湾法と日本法の共通点・相違点を明らかにしたい。

回顧日本《親族法》的修法歷程：2012年已完成《親權法》的修正，現正又著手《養子法》的修正，而《繼承法》則可於2018年間完成。本課程將著眼於一連串大幅修正（社會情勢、政府政策、新判例的出現）的立場，從「子女的福祉」、「配偶的保護」、「繼承的多樣化」等三個觀點，針對日本最近的立法中，其主要變動之處予以說明並檢討。最後，我們將觀察長年懸而未決的《婚姻法?親子法》修正，並講述今後家族法的動向。本課程除了透過向修課同學展示日本家族法近25年餘的進展，亦將藉由與修課學生進行互動和討論的方式，清楚地說明臺灣法與日本法之異同。

Appendix：Revisions which have not been made and Future Prospects

The revision of inheritance law will probably be completed in 2018 in Japan. Regarding the relatives law, the parental authority law was revised in 2012, but now preparations for the revision of the adoption law are in progress. In this course, based on a series of amendments (situation of society, policy of government, appearance of new precedent), the lecturer will explain and examine the major amendments in recent legislation (draft) from the perspectives of “welfare for children”, “protection of spouse” and “diversification of inheritance”. At last, we will look at the long-standing issues such as the amendment of the Marriage Law/Parent-Child Law, as well as future family law. The lecturer would like to demonstrate the trend of Japanese family law in this quarter century through this class. In addition, there will be Q&A sessions to clarify the similarities and differences between Taiwanese law and Japanese law.
